Term and Conditions

These Terms and Conditions govern your use of the Joinery Supplies Tasmania website and any enquiry, quote request, subscription or order submitted through it.

This website is operated by Joinery Supplies Tasmania Pty Ltd ABN 58 158 982 873 trading as Joinery Supplies Tasmania (“we”, “us”, “our”). These Terms and Conditions govern your use of this website and any enquiry, quote request, subscription, or order submitted through it. By accessing or using this website, you agree to these Terms and Conditions.

1. Use of this website

You may use this website only for lawful purposes and in a manner that does not infringe the rights of, restrict, or interfere with any other person’s use of the website.

You must not:

  • misuse the website or attempt to gain unauthorised access to any part of it;

  • upload malicious code, spam, or harmful material;

  • reproduce, copy, scrape, or exploit website content for commercial purposes without our prior written consent; or

  • use the website in any way that is unlawful, misleading, or fraudulent.

2. Website content

We take reasonable care to ensure the information on this website is accurate and current. However, product descriptions, images, technical information, specifications, pricing, availability, lead times, and other content may change without notice and may contain errors or omissions.

The information on this website is general in nature and is not professional design, engineering, fabrication, installation, legal, or technical advice. You should make your own enquiries and obtain professional advice where appropriate before relying on any website content.

2A. Reliance on information

You acknowledge that you have not relied on any representation, statement, or information not expressly set out in these Terms and Conditions or in a written agreement between you and us.

3. Product images, samples and specifications

Product photographs, swatches, samples, renders, and supplier materials are indicative only. Due to screen settings, manufacturing tolerances, lighting conditions, and the natural characteristics of materials such as timber, veneers, stone-look surfaces, laminates and decorative finishes, the final product may vary in colour, grain, texture, tone, pattern, or appearance.

Where products are natural, decorative, batch-based, or manufacturer-supplied, reasonable variations do not of themselves constitute a defect.

4. Enquiries, quotes and orders

Submitting a contact form, quote request, newsletter sign-up, trade application, or other enquiry through this website does not create a binding contract.

Any quotation we provide is subject to availability, supplier pricing, freight, lead times, specification review, and any conditions stated in the quote. Unless otherwise stated, a quote is indicative only and may be withdrawn or revised before acceptance.

A contract for the supply of goods or services is formed only when we accept your order in writing, issue an invoice or order confirmation, or otherwise commence supply.

We may refuse or decline an order where:

  • goods are unavailable;

  • there is a pricing or description error;

  • specifications, measurements or finishes are incomplete or unclear;

  • a product is discontinued or unavailable from a supplier; or

  • we otherwise have reasonable commercial grounds for doing so.

A quotation is not an offer and is capable of acceptance only when confirmed by us in writing. We may withdraw or revise a quotation at any time prior to such confirmation.

5. Custom, made-to-order and special-order products

Many products supplied by us are custom-made, cut-to-size, machined, fabricated, or specially ordered.

For those products:

  • you are responsible for ensuring that all measurements, quantities, drawings, plans, finishes, approvals, and specifications you provide are accurate and complete;

  • production may begin once specifications are approved or confirmed;

  • changes after approval may not be possible and, if possible, may incur additional cost and delay; and

  • custom, made-to-order, cut-to-size, and special-order goods are generally non-cancellable and non-returnable except where required by law.

6. Pricing and payment

Unless otherwise stated, all prices are in Australian dollars.

Quotes, invoices, and order confirmations will specify whether GST, freight, delivery, fabrication, installation, or other charges are included or excluded. Payment terms will be those set out in the relevant quote, invoice, approved trade account terms, or other written agreement.

We may require a deposit, part payment, or full payment before processing certain orders, including non-account purchases, special orders, and custom-made products.

7. Trade accounts

Trade account applications submitted through this website are subject to our approval process. Approval is not automatic.

If a trade account is approved, separate credit, account, or supply terms may apply. To the extent of any inconsistency, those specific approved trade terms will prevail over these website Terms and Conditions.

We may require directors, owners, or principals to provide guarantees, security, or other assurances as a condition of approving or maintaining a trade account.

8. Delivery, collection and inspection

Any delivery or collection dates we provide are estimates only unless expressly confirmed in writing.

You must ensure safe and reasonable access for delivery and, where relevant, suitable unloading arrangements. Risk in goods passes to you on delivery or collection, to the extent permitted by law.

You should inspect goods promptly on delivery or collection and notify us as soon as practicable if anything appears damaged, faulty, incorrect, or incomplete.

Title to goods remains with us until full payment has been received for those goods and any other amounts owing to us, to the extent permitted by law.

9. Returns, refunds and Australian Consumer Law

Our Return & Refund Policy forms part of these Terms and Conditions.

Nothing in these Terms and Conditions excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law or any other law where those rights cannot lawfully be excluded.

10. Intellectual property

All content on this website, including text, graphics, branding, logos, layouts, images, downloads, and other material, is owned by us or licensed to us and is protected by intellectual property laws.

You may view and print website content for your own personal or internal business reference only. You must not reproduce, adapt, publish, distribute, or commercially exploit any website content without our prior written consent.

11. Third-party links and supplier content

This website may contain links to third-party websites, manufacturer resources, technical documents, brochures, or external services. These are provided for convenience only.

We do not control and are not responsible for the content, accuracy, availability, or privacy practices of third-party websites. A link to a third-party site does not imply endorsement by us.

12. Limitation of liability

To the maximum extent permitted by law, we exclude liability for any indirect, incidental, special, or consequential loss arising from or in connection with your use of this website.

Where a law implies a guarantee, condition, or warranty that cannot be excluded, our liability is limited to the extent permitted by law, including to one or more of the following (at our option):
(a) for goods, the replacement or resupply of the goods, or the cost of doing so; and
(b) for services, the resupply of the services or the cost of doing so.

To the extent permitted by law, our total aggregate liability arising out of or in connection with these Terms and Conditions or your use of this website will not exceed the amount paid by you (if any) for the relevant goods or services giving rise to the claim.

Nothing in these Terms and Conditions excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law or any other law where those rights cannot lawfully be excluded.

13. Privacy

Any personal information you provide through this website will be handled in accordance with our Privacy Policy.

14. Changes to these Terms

We may update these Terms and Conditions from time to time by publishing a revised version on this website. The updated version will apply from the date it is published.

14A. Events beyond our control

We are not liable for any delay or failure to perform any obligation under these Terms and Conditions where such delay or failure is due to events beyond our reasonable control, including but not limited to supplier delays, transport or freight disruptions, labour shortages, industrial action, natural events, or other unforeseen circumstances.

15. Governing law

These Terms and Conditions are governed by the laws of Tasmania, Australia, unless a mandatory law in another Australian jurisdiction applies.
